By creating an account, downloading our software, or using any part of the SkillExus™ platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

• If you are under 18, you must have parental or guardian consent
• You must have the legal capacity to enter into binding agreements
• Your use must comply with all applicable local, national, and international laws

SkillExus™ provides an AI-powered gaming coach and analytics platform that includes:

3. User Accounts and Registration

3.1 Account Creation

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain multiple accounts

3.2 Account Security

• Use strong, unique passwords for your account
• Enable two-factor authentication when available
• Do not share your account credentials with others
• Log out from shared or public devices

4. Subscription and Payment Terms

• Cancellation takes effect at the end of your current billing period
• No refunds for partial months or unused portions of subscriptions
• 14-day cooling-off period applies for EU consumers as per EU Consumer Rights Directive

• Trademarks, logos, and brand elements

6.2 User-Generated Content

For content you create and share through our platform (such as drill packs in our marketplace):

• You retain ownership of your original content
• You grant us a license to host, display, and distribute your content
• You represent that you have the right to share such content
• You agree not to infringe on others' intellectual property rights

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.1 Gaming Data

• We collect gameplay data to provide coaching and analytics services
• Data is processed in accordance with GDPR and Belgian data protection laws
• You can request access, correction, or deletion of your data
• Data is stored securely within the European Union

8. Third-Party Integrations and Game Compatibility

8.1 Game Integration

Our overlay technology integrates with various PC games. We make reasonable efforts to ensure compatibility but cannot guarantee:

• Compatibility with all games or game versions
• Continued compatibility after game updates
• Performance on all hardware configurations
• Compliance with all game publishers' terms of service

9. Disclaimers and Limitations of Liability

• Our liability is limited to the amount paid for services in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for third-party game compatibility issues
• Nothing in these Terms limits liability for death, personal injury, or fraud

10. Pro Drill Marketplace

10.1 Content Creation and Sales

Elite Master subscribers may create and sell drill packs in our marketplace:

• Content must be original and not infringe on third-party rights
• We reserve the right to review and approve content before publication
• Revenue sharing terms are specified in your subscription agreement
• We may remove content that violates our guidelines

10.2 Purchasing Content

• All marketplace purchases are final
• Content is licensed for personal use only
• We do not guarantee the effectiveness of third-party content
• Refunds may be available in cases of technical issues or misrepresentation

11. Termination

11.1 Termination by You

• You may terminate your account at any time through account settings
• Termination does not entitle you to refunds for unused subscription periods
• You remain responsible for any outstanding payments

11.2 Termination by Us

We may terminate or suspend your account if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay subscription fees
• Engage in fraudulent or illegal activities
• Pose a security risk to our platform or other users

12. Governing Law and Dispute Resolution

12.1 Applicable Law

These Terms are governed by Belgian law. Any disputes will be subject to the exclusive jurisdiction of the courts of Charleroi, Belgium.

12.2 EU Consumer Rights

If you are an EU consumer, you retain all rights under applicable consumer protection laws, including the right to pursue disputes in your country of residence.

12.3 Alternative Dispute Resolution

Before pursuing legal action, we encourage you to contact us directly to resolve any disputes. EU consumers may also use the European Commission's Online Dispute Resolution platform.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Send email notifications to registered users
• Provide at least 30 days' notice for material changes
• Allow you to terminate your account if you disagree with changes
